Welcome to PocketFans! These Terms of Service ("Terms") govern your use of our website, services, and any products purchased through thepocketfans.com. By accessing or using our site, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

By using our Services, you confirm that you are at least the age of majority in your jurisdiction and have the legal capacity to enter into this agreement. If you are using the Services on behalf of a minor, you are responsible for their compliance.

3. Product Disclosure & Collector Disclaimer

The PocketFans Collector Box is a collectible product. Each box contains unique items including hand-signed cards, sealed booster packs, and authenticated digital content. Because each box is sealed and contains verifiable, limited-edition components, all sales are final once shipped.

We do not guarantee future resale value, grading results, or market performance of any item. Collectibles may increase or decrease in value over time. PocketFans does not provide appraisals or third-party authentication services beyond the included certificate and video proof.

4. Product Transparency

To ensure value and fairness for collectors, PocketFans maintains strict guidelines on what is included in our boxes. We do not include the following items:

• Trick Or Trade (Halloween) booster packs
• McDonald's booster packs
• Pokémon GO booster packs
• Detective Pikachu booster packs
• 3 Card Packs (or packs with less than 9 cards)
• Weighed booster packs
• Previously opened booster packs
• Holographic cards valued under $10 at the time of purchase

By excluding these items, we aim to provide transparent value and protect our customers from filler or low-value products. This policy reflects our commitment to building a product and brand that the collector community can trust.

5. Orders & Payment

All orders are subject to acceptance and availability. By submitting an order, you authorize us to charge your selected payment method for the full purchase amount, including applicable taxes and shipping fees. Once an order is shipped, it is considered final and non-refundable.

6. Shipping & Risk of Loss

We ship to the address provided at checkout. Title and risk of loss pass to you upon delivery to the shipping carrier. In the event of transit damage, we will assist in filing a carrier claim. We may request photos and supporting information to proceed.

7. Refunds & Returns

Due to the collectible nature of our products, we cannot accept returns or offer refunds after a product has shipped. If your order arrives damaged, please contact info@pocketfans.org within 5 business days with photos so we can open a shipping claim. For more details, please see our Refund Policy.

8. Intellectual Property

All content, images, trademarks, and materials on our site are the property of PocketFans, Inc. or its licensors. You may not copy, reproduce, distribute, or use our content without prior written permission.

9. User Conduct

You agree not to misuse the site or services. This includes, but is not limited to, engaging in fraudulent activity, interfering with site operations, or violating any applicable laws. We reserve the right to terminate your access if we determine you have violated these terms.

10. Resale

We understand that many customers purchase collectibles for resale or trade in the secondary market, which is a normal part of the collector community. PocketFans, Inc. does not restrict the resale of our products once purchased, provided that items are represented accurately and not altered in a way that misrepresents their authenticity. We reserve the right to refuse future sales to individuals or entities engaging in deceptive or fraudulent resale practices.

11. Feedback & Submissions

Any feedback, suggestions, or content you submit to us may be used by PocketFans, Inc. without restriction or compensation. By submitting content, you confirm that you have the legal right to share it and that it does not infringe any third-party rights.

12. Disclaimer of Warranties

Our services and products are provided “as is” and “as available.” We do not guarantee that use of our website will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

13. Limitation of Liability

PocketFans, Inc. is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services or products. Our total liability shall not exceed the amount you paid for the product in question.

14. Indemnification

You agree to indemnify and hold PocketFans, Inc., our partners, and Shopify harmless from any claims arising from your misuse of the Services or violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Orange County, CA.

We reserve the right to update these Terms at any time. Any changes will be posted on this page with an updated revision date. Continued use of the Services following changes constitutes acceptance of the updated Terms.
